GESTIÓN Y PLANEAMIENTO TERRITORIAL Y MEDIOAMBIENTAL, SA (hereinafter Gesplan ), with Tax Identification Number A-38279972, informs you that, in accordance with Articles 5, 12 and 13 of the European General Data Protection Regulation 679/2016, of April 27 (GDPR) , and Articles 5, 6, and 11 of Organic Law 3/2018 , of December 5, on the Protection of Personal Data and Guarantee of Digital Rights (LOPDGDD) , regarding the processing and the duty of confidentiality, your personal data will be processed by Gesplan, as the Data Controller, for the purposes of managing queries, communications, internal processes, personnel selection processes —including the evaluation of possible conflicts of interest—, job bank, hiring and for the proper development of the relationship between the parties. The data provided will not be transferred to third parties, except in cases where there is a legal obligation.

The data subject shall have the right to withdraw their consent at any time. The withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal (Article 7.3 of the GDPR).

Gesplan guarantees the proper use of information, and especially the personal data contained in its files, as well as full compliance with obligations regarding the protection of personal data. Furthermore, it undertakes not to process personal data for purposes other than those agreed upon.

Gesplan undertakes to inform and ensure that its employees comply with the obligations established by law, and in particular, the duty of secrecy, confidentiality, and compliance with security measures for files containing personal data. Furthermore, it will take measures to guarantee that any person who has access to personal data may only process such data following its instructions, unless required to do so under Union or Member State law.

Gesplan will implement appropriate technical and organizational measures to ensure a level of security appropriate to the risk, which, where applicable, includes, in accordance with Article 32 of the GDPR, among others:

1. Pseudonymization and encryption of personal data.
2. The ability to ensure the ongoing confidentiality, integrity, availability, and resilience of treatment systems and services.
3. The ability to quickly restore the availability and access to personal data in the event of a physical or technical incident.
4. A process of regular verification, evaluation and assessment of the effectiveness of technical and organizational measures to ensure the safety of the treatment.

Gesplan is authorized to retain personal data, duly blocked , for as long as responsibilities may arise from its relationship with the interested party or when there is a legal obligation to retain said data.

Gesplan guarantees, in accordance with Community and national regulations on the protection of personal data, the protection of personal data and the exercise by its holders of the rights recognized in articles 15 to 21 of the GDPR, and in articles 13 to 18 of the LOPDGDD.
